Please read these Terms & Conditions carefully before using the NCHRG app. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, please do not use the app.
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and Platinum North Systems ("Company", "we", "us") governing your use of the NCHRG mobile application and any related services (collectively, the "Service"). By accessing or using the Service, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms.
NCHRG is a personal and business document organizer that allows users to store, manage, and organize records including identity documents, financial records, vehicle records, insurance policies, warranties, property records, and business documents. Company maintains reasonable administrative, technical, and physical safeguards appropriate to the nature of User Content, but does not warrant that the Service will be completely secure or free from unauthorized access. The Service also includes an AI-powered assistant, push notification reminders, and optional document sharing features.
To use NCHRG, you must create an account by providing accurate, current, and complete information. You are responsible for:
Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized access to your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
Use the Service for any illegal activity or in violation of any applicable law or regulation
Upload, store, or share content that is fraudulent, defamatory, obscene, or infringes on any third party's rights
Attempt to gain unauthorized access to any part of the Service, its servers, or any connected systems
Reverse-engineer, decompile, or disassemble any part of the app
Use automated tools, bots, or scrapers to access the Service
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Interfere with or disrupt the integrity or performance of the Service
All documents, records, and data you upload or create within the app ("User Content") remain your property. By storing User Content in the Service, you grant Company and its service providers a limited, non-exclusive license to access, reproduce, process, transmit, display, and otherwise use that content as reasonably necessary to provide, maintain, secure, troubleshoot, improve, and administer the Service, including optional document-sharing.
Company and its service providers do not access, review, or use your User Content for any purpose other than providing, maintaining, securing, troubleshooting, improving, and administering the Service, including optional document-sharing functionality. You are solely responsible for the accuracy, legality, and integrity of the content you store.
Certain features of NCHRG may require a paid subscription. By subscribing, you agree to the following:
Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected), and you will be charged at the beginning of each selected billing period
Payments are processed through Stripe and are subject to their respective billing terms
Subscriptions automatically renew for successive billing periods unless you cancel through your account settings or by contacting us at least 24 hours before the end of the current billing period; cancellation takes effect at the end of the current billing period
We do not offer refunds for unused portions of a subscription period, except where required by applicable law
We reserve the right to change pricing with reasonable advance notice; provided that, for an active prepaid subscription, any pricing change will take effect no earlier than the next renewal period unless the User affirmatively accepts the change or applicable law permits an earlier effective date, and will provide any renewal or cancellation disclosures required by applicable law
Your use of the Service is also governed by our Privacy Policy and Consumer Health Data Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.
The Service integrates with third-party services including Google Sign-In, Sign in with Apple, Firebase, and Microsoft Azure. Your use of these integrations is subject to the respective terms and privacy policies of those providers. We are not responsible for the practices or content of third-party services.
All content, trademarks, logos, software, and technology comprising the Service — excluding User Content — are the exclusive property of Platinum North Systems or its licensors. You are granted a limited, non-transferable, revocable license to use the app for personal or business use in accordance with these Terms. No other rights are granted.
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Any outputs generated by the Service may be inaccurate, incomplete, or unsuitable, are provided for general informational purposes only, do not constitute professional advice, and must be independently reviewed before reliance or action. We are not liable for any loss or damage arising from your reliance on information stored in the app, including but not limited to financial, legal, or medical decisions made based on stored records.
To the fullest extent permitted by applicable law, Platinum North Systems and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the Service — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Platinum North Systems and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice. Where reasonably practicable and permitted by applicable law, we will provide notice and a reasonable opportunity for you to export your User Content before deleting or de-identifying it from our active systems. We may immediately restrict access to, remove, or delete User Content without prior notice, in accordance with applicable law, where we reasonably believe doing so is necessary to protect the Service, users, or third parties; comply with applicable law or legal process; or address a violation of these Terms. Any User Content not exported before termination may be deleted or de-identified within a reasonable period, subject to the retention exceptions described above, and may not be recoverable.
You may also delete your account at any time from within the app. Upon deletion of your account, your access to the Service and User Content will cease, and we will delete or de-identify your User Content from our active systems within a reasonable period, except to the extent retention is required by applicable law, necessary to resolve disputes or enforce these Terms, or the content remains in routine backup systems until overwritten in accordance with our backup-retention practices. You are responsible for exporting any User Content you wish to retain before deleting your account. Following deletion, User Content may not be recoverable, and we have no obligation to restore it.
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of New Hampshire, and you consent to the personal jurisdiction and venue of those courts.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via the app or by email. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
